NASAA’s Proposed Commentary to the 2008 Franchise Registration and Disclosure Guidelines

NASAA’s Franchise and Business Opportunities Project Group has released for internal and public comment a proposed Commentary to the 2008 Franchise Registration and Disclosure Guidelines (“2008 Franchise Commentary”).

The 2008 Franchise Commentary contains practical guidance about complying with new Franchise Registration and Disclosure Guidelines and addresses questions of interpretation that have arisen about those Guidelines. The 2008 Franchise Commentary also incorporates specific items under several previous Commentaries that NASAA adopted regarding the Uniform Franchise Offering Circular Guidelines.

The internal and public comment period will remain open for 30 days from September 23, 2008.  Comments to the proposed 2008 Franchise Commentary are invited.  Written comments should be sent by e-mail or in writing to Dale E. Cantone, Chair of the Franchise and Business Opportunities Project Group, and to the NASAA Legal Department.
